Welcome to Solist. These Terms of Service ("Terms") govern your access to and use of the Solist platform at solist.rent (the "Platform"), including our website, mobile applications, and services.
By accessing or using Solist, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.
We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
Solist is a peer-to-peer marketplace that connects people who want to rent items ("Renters") with people who have items available for rent ("Owners"). Solist provides the platform and tools to facilitate these transactions but is not a party to the rental agreements between users.
Important: Solist is not a rental company. We do not own, operate, manage, or control any listings. Owners are independent third parties responsible for their items and rental terms.

You must create an account to access most features of Solist. You agree to provide accurate, current, and complete information and to update your information as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
We may require identity verification to access certain features, including listing items or making bookings. Verification helps maintain trust and safety on the Platform.
Owners may create listings for items they own and have the right to rent. By creating a listing, you represent that:

You grant Solist a non-exclusive, worldwide, royalty-free license to use, display, and distribute your listing content (including photos and descriptions) to operate and promote the Platform.
Renters request bookings through the Platform. Owners have 48 hours to respond to booking requests. Once an Owner approves a request, the Renter has 48 hours to complete payment. Failure to meet these deadlines results in automatic cancellation.
When a booking is confirmed, a rental agreement is formed between the Owner and Renter. Solist is not a party to this agreement but facilitates its execution. Both parties agree to:
Renters must report any issues with items within 24 hours of pickup. Issues reported within this window are presumed to be pre-existing (Owner responsibility). Issues reported after 24 hours are presumed to have occurred during the rental (Renter responsibility). This affects how disputes and deposits are handled.
Cancellation policies vary by listing. Owners set their cancellation terms, which are displayed before booking. Refunds are processed according to the applicable cancellation policy.
All payments are processed through Stripe. By using Solist, you agree to Stripe's terms of service. Solist does not store your full payment card information.
Solist charges a service fee for each completed transaction. Current fees are displayed during the booking process. We reserve the right to modify fees with reasonable notice.
Owners may require security deposits, which are held during the rental period. Deposits are released after successful return or captured (fully or partially) if damage occurs. Disputed deposits are resolved through our dispute process.
Owners receive payouts after rentals are completed. Payout timing and methods depend on your Stripe Connect account settings. Solist is not responsible for delays caused by Stripe or your financial institution.
By using Solist, you agree to receive communications related to your account, bookings, and transactions via email and (if opted in) SMS. These transactional messages are necessary for Platform operation.
By opting in to receive SMS messages from Solist, you agree to the following:
All rental-related communication should occur through the Platform's messaging system. This creates a record for dispute resolution and protects both parties.

Users can leave reviews after completed rentals. Reviews must be:
Solist may remove reviews that violate these guidelines but does not verify or endorse user reviews.
We encourage users to resolve disputes directly. If you cannot reach a resolution, either party may open a dispute through the Platform. Solist will review the evidence (including photos, messages, and checkout/check-in records) and make a determination.

Solist's dispute decisions regarding deposits are binding on both parties with respect to amounts held by the Platform.
Owners are responsible for ensuring their items are safe, functional, and as described. Owners should maintain appropriate insurance for their items and activities.
Renters are responsible for using items safely and according to instructions, returning items in proper condition, and covering damage or loss beyond normal wear and tear.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SOLIST DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOLIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
IN NO EVENT SHALL SOLIST'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SOLIST IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
You agree to indemnify, defend, and hold harmless Solist and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
You may close your account at any time through Account Settings. We may suspend or terminate your account for:
Upon termination, your right to use the Platform ceases. Provisions that should survive termination (such as limitation of liability) will remain in effect.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or Platform use shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court.
Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.
